Plaintiff’s decedent, 92, was a memory care resident at Doe assisted living facility. She suffered from advanced dementia, was bed/wheelchair bound, non-communicative, and required the assistance of two staff members with all transfers. Decedent suffered a fall during a bed-to-wheelchair transfer that was performed by only one facility staff member. She was not immediately evaluated for injuries and did not receive medical treatment until she was transported to the hospital two days later. At the hospital, decedent was diagnosed with a left femur fracture that required surgical repair. While the surgical repair was successful, decedent never fully awoke from the anesthesia and died five days later. The case settled prior to expert disclosures.
