Woe underwent a C-section for delivery of her baby and was thereafter readmitted to a hospital because the suture line from her surgery had reopened. A wound vac was ordered for her treatment, and she was discharged four days later. During her admission to the hospital, she was assessed by a wound care nurse and her treatment included applying two pieces of black Granufoam to the wound. The wound care nurse directed that the Granufoam be changed every other day. The Granufoam was used to treat Woe’s wound as the Granufoam stimulates healing by drawing tissue into the wound, but it needed to be changed every two to three days by directions.

After discharge from the hospital, a registered nurse employee of a home health agency failed to recognize or appreciate that two pieces of black Granufoam had been applied to her wound. Thereafter, various employees of the home health agency assessed, cleaned, and treated Woe’s surgical wound but failed to change the second piece of black Granufoam, which went unchanged for 40 days. She was then discharged from care by the home health agency. Seve
