Nursing Home Negligence

Jane Doe and Dick Moe were both residents in Woe’s dementia memory care unit. Doe, age 79, had no serious health problems. Moe was mobile and would wander the facility. Moe had a history at prior facility of some aggressive behaviors. An unwitnessed altercation occurred involving Doe and Moe, resulting in injury to her lower right leg requiring hospitalization and debridement surgeries for her massive loss of calf tissues. She had a wound vac placed and additional surgery involving a skin graft harvested from her hip. Extensive therapies and nursing home health care allowed Doe to transition to an assisted care facility. The case was heavily defended on notice grounds. A staff member testified in her deposition that Moe was violent and aggressive with Woe’s staff prior to the incident. The case settled through mediation two weeks before trial.
