On March 20, 2024, the plaintiff, a 25-year-old pedestrian, attempted to cross Lynnhaven Parkway in between intersections to get to the Hampton Roads Transit bus stop in Virginia Beach. At that same time, the defendant was driving her 1991 Honda Accord in the left eastbound lane of Lynnhaven Parkway and struck the plaintiff as she attempted to cross. The plaintiff suffered life-altering injuries, including a traumatic left lower leg amputation, multiple fractures to her right scapula, humerus and fibula, and grade 3 lacerations to her liver and right kidney. The injuries required a 21-day hospitalization, followed by further rehabilitation at a short-term facility. State Farm initially relied on a contributory negligence defense. The case concluded with a settlement of $275,000 out of the defendant’s $300,000 policy limits.
